RA11965: AN ACT INSTITUTING POLICIES FOR THE PROTECTION AND WELFARE OF CAREGIVERS IN THE PRACTICE OF THEIR OCCUPATION

Republic Act No. 11965, also known as the "Caregivers' Welfare Act," is a landmark legislation aimed at protecting and promoting the well-being of caregivers in the Philippines. This law establishes policies for the practice of the caregiving occupation, recognizing the vital role caregivers play in national development. It ensures decent employment and income for caregivers, protecting them from abuse, harassment, violence, and economic exploitation. The Act covers caregivers employed in private homes, nursing or care facilities, and other residential settings, whether directly hired or placed through employment agencies. It mandates the execution of employment contracts, outlines pre-employment requirements, specifies duties, and sets standards for working hours, minimum wage, and benefits, including 13th month pay, service incentive leave, and coverage under SSS, PhilHealth, and Pag-IBIG.

The significance of this law for the people lies in its comprehensive approach to formalizing and safeguarding the caregiving profession. By setting clear standards for employment, compensation, and benefits, it aims to uplift the status of caregivers and ensure they receive the dignity and respect they deserve. The Act also provides avenues for dispute resolution and outlines responsibilities for private employment agencies, further protecting caregivers from exploitation. For clients and their families, the law promotes the availability of competent and professional caregivers, ensuring quality care while also establishing boundaries regarding privileged information. Ultimately, RA 11965 contributes to a more equitable and professional caregiving sector, benefiting both caregivers and those who rely on their essential services.
