RA11643: AN ACT GRANTING SURVIVORSHIP BENEFITS TO THE SURVIVING LEGITIMATE SPOUSE AND DEPENDENT CHILDREN OF A DECEASED RETIRED MEMBER OF THE NATIONAL PROSECUTION SERVICE AND APPROPRIATING FUNDS THEREFOR

This Act grants survivorship benefits to the legitimate spouse and dependent children of deceased retired members of the National Prosecution Service (NPS), or those eligible for optional retirement at the time of death. This includes all prosecutors in the Office of the Secretary of Justice, Regional Prosecution Offices, and Provincial and City Prosecutors' offices. The law defines "dependent" broadly to include legitimate, illegitimate, or legally adopted children under 21 who are chiefly reliant on the deceased, or those incapable of self-support due to mental or physical defects, ensuring comprehensive support for the families of deceased prosecutors.

The surviving legitimate spouse will continue to receive these retirement benefits for life or until remarriage, sharing them equally with dependent children. Furthermore, the Act has a retroactive effect, extending these benefits to surviving spouses and dependent children of NPS members who died one year prior to its effectivity, providing much-needed financial security to a wider group of beneficiaries. This measure aims to provide a safety net for the families of those who dedicated their lives to public service in the National Prosecution Service.
